Heartwood HOA Pool Rules and Regulations


1.      All Annual Assessments must be paid in full prior to use of the pool. If your HOA fees are not up to date, entrance in the pool area will not be permitted.

2.      Key Cards are required to enter Pool Area. A maximum of 2 per home. Key Cards can be purchased from Management at a non-refundable fee (Key Card is $10.00).

3.      The Homeowner’s Association will not be responsible for any money or property loss sustained by homeowners or their guests when using the pool.

4.      Homeowners are requested to instruct their children or guest’s children in personal hygiene (e.g., instruct them to use the restroom facilities in the pool area). 

5.      The pool operator will be posted onsite.

6.      Due to a limited capacity, no private parties will be allowed. 

7.      The board members will determine the penalty for violation of any of the rules listed below. 

8.      Management of Heartwood and/or a Board has the power to close the pool whenever the safety or heath of the participants is endangered.

9.      Rules and Regulations are subject to change at anytime. 


 

RULES AND REGULATIONS


1.      There will be NO lifeguard on duty. All Owners and Guests should use the pool at their own risk. Heartwood HOA will not be responsible for any accidents or injury in or around the pool.

2.      The pool is seasonally, April through October. Hours are 9:00 am to 10:00pm

a.      Anyone entering the pool area outside of these hours of operation is considered trespassing and will be subject to arrest. 

3.      The maximum capacity for the pool area is 81 people.

4.      A responsible party must supervise patrons under the age of 12 at all times. A responsible party is defined as a person 16 years of age or older. 

5.      Pool Chairs will be provided around pool area. Each homeowner and their guest are responsible for cleaning up their surroundings properly. 

6.      All furniture provided must remain in the cabana and/or by the pool. Furniture shall not be removed from pool area. NO furniture in the Pool.

7.      All swimmers must wear proper swimming attire. Street clothing is not permitted in the pool under any circumstances.

a.      All swimmers must shower before entering the pool.

b.      Life jackets may be worn in the pool if needed.

c.      Infants are required to wear swim diapers in the pools.

d.      If you notice evidence of fecal or other contamination (e.g., vomit), please take the initiative to evacuate the pool even if you, your child, or your guest did not cause the contamination. Then contact the pool management company immediately to report the incident.

e.      Pool entrance is not advised to anyone wearing bandages, or with skin abrasions, colds, coughs, extremely inflamed eyes, open sores, infections, excessive sunburn, nasal or ear discharge, or any other symptoms to be detrimental to the health of others. 

8.      Food and Beverages may be brought into the pool area and cabana but are not permitted in the pool. All trash must be placed in the trash containers provided.

a.      No alcoholic beverages or drugs are allowed in pool area or cabana.

b.      Intoxicated persons shall not be allowed in the pool area. Any person in authority may call law enforcement authorities for assistance in dealing with an intoxicated person.

9.      No running, pushing, dunking, rough play, or any type of personal conduct endangering safety of self and others is allowed. 

a.      Absolutely no diving in the pools or flips from the side are allowed at any time. 

b.      No scooters, skateboards, roller blades or bicycles, etc. are to be used inside the pool area or cabana. 

c.      No large rafts or flotation devices shall be allowed in the pool. Balls, toys, small baby floats, and noodles may be allowed, but please be courteous of surroundings in pool.

10.    The following items and activities are prohibited:

a.      NO GLASS of any kind is permitted in the pool area or cabana, including beverage containers.

b.      Foul or abusive language will not be tolerated in pool area.

c.      No pets are allowed in pool area or cabana.

d.      No smoking is permitted within the pool area or cabana at any time.

e.      No grilling of any sort will be tolerated in pool area or cabana.

f.       Music, and/or any other noise, must be kept at a level that it cannot be disturbing to others using the pool area.
